Associate Director, Compliance and Legal (APAC, ME, LATAM)

You will be part of the legal and compliance team of the Emerging Markets business in LATAM, Middle East and Africa, Japan, Korea, China, South East Asia, Australia and New Zealand.

Our team is influential and proactive and has a direct interface with the senior management team. You will work closely with our regional Compliance leads and legal team. This position will interact with employees at all levels, in all our territories and in all functions. Whilst this position is described to lead on risk assessment, monitoring and investigations and third party oversight this does not preclude additional responsibilities and functions to be given to you as part of your work. We also expect you to handle various projects, CAPA oversight, and implementation and remediation's as part of your job.

You will indirectly manage the local legal and compliance team in order to ensure consistency of approach regarding third parties, monitoring and investigations.

REQUIREMENTS

Qualifications:
* BA/BS degree
* 10+ years of related work experience, and 4+ years of pharmaceutical and/or healthcare industry experience
* Demonstrated leadership skills and strategic focus required.
* Demonstrated ability to exercise independent judgment, effectively collaborate with multiple functional units, lead with authority, exercise tact and discretion in assessing compliance needs, and to respond timely and accurately to compliance inquiries.
* Working as a business partner in a matrixed environment.
* Demonstrated ability to see the "big picture" and implement systems and process designed to streamline and effect necessary change.
* Ability to outsource and automate repetitive process
* Influence and effect change throughout our business and with our employees.
* Excellent oral and written communication, presentation, teaching and coaching skills required. Ability to effectively communicate compliance issues verbally and in writing in a clear and understandable manner.
* Demonstrated ability to inspire trust and confidence through effective communication and interpersonal skills.
* Demonstrated ability to be proactive, identify and focus on critical priorities with little or no supervision, and manage multiple projects simultaneously.
* Knowledge of and experience in developing the strategy for and implementing processes and systems that govern transactions and approval workflow on a global level
* Strong work ethic and ability to produce high quality work under deadline pressures.
* Travel up to 45% and in cases of emergencies flexibly.

RESPONSIBILITIES

GENERAL
* Ensure consistent practices and use of policies and SOPs throughout the region
* Ensure effective training and education of the compliance team
* Developing effective lines of communication with the business and compliance teams to implement the regional compliance policy, monitor and to ensure the identification and escalation of risks.
* Strong and effective support to compliance leads and lends support in establishing goals, plans and assignments for each team member.
* Provides coaching and enhance work processes to optimize the effectiveness/efficiency of our compliance team throughout the region
* Ensure you have a global overview and regular review of the following:
1 Due diligence
2 Third Party Intermediaries
3 Risk Committees minutes and dashboards
4 Monitoring programs both in country and from regional
5 Investigations
* Support management of Regional Risk Committee to review results and manage internal alignment and reporting
* Ensure our compliance systems are optimal and aligned where possible
* Working with the Policy and SOP team, support drafting, overview and implementation of key policies for Risk Assessment, Monitoring and Investigation & Third Party Oversight.
* Support implementation, training and refresher training of policies
* Periodically monitor implementation and effectiveness of policies
* Plan to outsource repetitive process and to use automation where possible
* Develop Data Analytics
* Work closely with other functions to embed compliance process and culture throughout the business.
* Working on projects with lawyers
* Leading regional investigations

RISK ASSESSMENT
* Enhance the existing culture of Risk Management supported by policies and Standard Operating Procedures (SOPs) and committees
* Establish and oversee formal Risk Analysis and self-assessment programs for the company
* Analyze, develop, manage, implement and co-ordinate Risk Management matters by identifying, measuring and reporting on operational or enterprise risks for the company working with a cross functional risk team
* Develop a risk register to be reviewed Quarterly and Annually by senior management
* Support implementation of systematic training for relevant staff to understand the policies and plans, and are given assistance when needed.
* Co-ordinate and support management of the Regional Risk Management Committee.

MONITORING
* Conduct a review of existing monitoring programs company-wide and assess best practice, identify opportunities to develop and or expand monitoring
* Develop a strategy to implement a Level 2 business compliance monitoring program that aligns company compliance requirements to regulatory expectations and industry practice
* Develop and implement Data Analytics process to complement monitoring testing
* Integrate Level 2 Monitoring program with Investigations and local monitoring processes
* Support development of central storage system for recording monitoring observations and remediation actions (CAPAs)
* Conduct periodic review and testing of local Compliance policies and SOPs, to ensure alignment with regional policy and templates
* Provide mentoring and training to compliance officers and champions on local monitoring activities
* Performs on-site spot checks of field force's education events

INVESTIGATIONS
* Review effectiveness of compliance hotline and complaint intake channels and procedures company-wide
* Review complaint intake procedure and management of allegation and case management in case management system
* Establish procedure for managing anonymous allegations for investigation based on severity and risk, ensuring allegations are assigned appropriately for action
* Assist local to perform low risk investigations; build capability within on investigation activities
* Respond to serious and or urgent investigations at short notice
* Working with HR and Legal develop a consistent disciplinary framework and matrix for compliance violations
* Support development of central database for the recording and tracking of investigations findings and remediation (CAPAs) integrated with Monitoring tracking

THIRD PARTY INTERMEDIARY OVERSIGHT
* Set up a Risk-Based and Integrated Process to manage oversight, tracking and management of Third Party Intermediaries.
* Work with Legal to update and enhance the compliance process for relevant procurement and vendor management processes including contractual control and audit of the processes and activities
* Ongoing management and monitoring of relationships
* Establish process for regular monitoring of engagements
* Support integration of management and oversight data, including Develop the outsourced Due Diligence and Enhanced processes to meet the requirements of all policies and procedures as well as applicable anticorruption laws and regulations, including:
* Refresher training, Due Diligence questionnaires, Internet and risk database research, Interviews
* Ensures a proper digital/paper-based documentation of the entire Due Diligence processes
* Ensure regular overview of due diligence.
